President's Directive On Tuk-Tuks To Complicate Transport Management

In his first 2016 Post-Election Media briefing in Rwakitura, President Yoweri Museveni blamed KCCA’s Executive Director Jenifer Musisi for the NRM’s party loss in Kampala district. NRM had garnered 31.09% against FDC’s 65.75% in the Presidential Election. “The only problem was Madam Musisi who was doing the correct thing of introducing order in the city by removing hawkers from selling on the pavements and so on which was correct. But the mistake was she did not; first of all sensitize them.” Said, President Yoweri Museveni.

Jenifer Musisi’s policies to reform and develop the city when she was first appointed in 2011 dealt with among other things removing vendors from the streets, levying taxes on commuter taxis to collect revenue for KCCA. Now on Tuesday, Kampala Minister Betty Kamya was on the receiving end when her ban on the TUK TUK was reverted by the President as he addressed Boda Boda and Taxi operators in Kasangati ahead of a campaign rally for the Kyadondo East NRM Parliamentary candidate Sitenda Sebalu. “The laws of Uganda don’t provide for tricycles to carry passengers.” Said Betty Kamya. “You want to use tricycles, please go ahead and do so.” Said, President Yoweri Museveni.

Kamya cited chapter 4 clause 2 of the Traffic and Road Safety Act of 2016 which read as follows; A License shall not be granted to a motorized tricycle to operate in the central business district and to carry passengers. Also, chapter 11 of the same Act read; the driver of a motorized tricycle shall not carry passengers for hire or reward. Government expert Godber Tumushabe described the President’s tendency to overturn critical decisions like this as a dysfunctionality of the government. “Because you would assume that if there is a fundamental decision that a Minister has announced like reorganizing the transport in the city. At worst, the cabinet has approved that decision and if the cabinet approves the decision like that, then it means that actually, the President has approved it. So the idea that the President then comes and reverses the decision of the Minister is just a misnomer and it shows you the degree of dysfunctionality of government. ” Said Godber Tumushabe, Policy Analyst. Kamya had also directed the Police to implement the order by arresting those who defied it.
