UCU Loses Court Battle Against Students

The 2-year quest for justice ended throwing students into jubilation and chanting after Mukono Court presided over by Justice Margaret Mutoni ruled in favor of two Uganda Christian University students who were expelled for reportedly inciting violence amongst students. “An order prohibitions hereby issue prohibiting that the University from enforcing the departed decision and victimizing the victims in any way over the allegations of 20th April 2016. Both Applicants are awarded general damages of 10 million shillings each.” Said, Margaret Mutoni – Mukono High Court Judge.

Delivering her ruling, the Judge stressed that; well as Semuwembe Simon and Ssentumbwe Yasin faulted the University organs including the Student’s and the University’s Disciplinary Committees, deliberately failed to adhere to the set disciplinary procedures and unfairly dismissed the dual. “The manner in which the disciplinary process was handled was ruthless, unchristian, inhuman, degrading and lacking parental characteristic which is expected of student/Lecturer relationship.”

The Judge also faulted the University’s Vice-Chancellor Dr. Ssenyonyi for overstepping mandate. “He was the complainant in allegation of the alleged demonstration without his permission and alleged abusive language against him. He became the judge in his own case which is against the rules of natural justice.” The Judge also counseled the University to review their rules and regulations describing them as ambiguous. “I found the handbook very wanky in as much as it does not define a minor offense and a major offense. It does not prescribe the punishment for the minor offense and major offense.” The two students who were accompanied by their lawyer Isaac Semakadde and a group of other UCU students came out of Court jubilating and chanting for the victory reached.
